A Geneva-based food delivery service operates a staff leasing service vis-à-vis Uber and therefore requires a statutory license. This was decided by the Federal Supreme Court. The company's couriers use the UberEats app.

The drivers' work is determined by the use of the app to such an extent that the conditions for staff leasing are met. The Federal Supreme Court came to this conclusion in a ruling published on Thursday.

The company has concluded a license agreement with Uber for the use of the app. Its approximately 400 bike couriers would receive all order details via the app. Customers could give additional instructions.

In addition, the application monitors the drivers' work schedules and radius of action in real time. The couriers are also required to systematically accept and carry out the orders assigned to them.
