The Federal Administrative Court has rejected a state liability claim by the girlfriend of the Portuguese man murdered in Morges VD in 2020. He was stabbed to death by a self-proclaimed IS assassin.

The murdered man's girlfriend argued that the convicted man had been released from prison despite several alarm signals. This had been ordered due to an attempted arson. According to the girlfriend, the release of the perpetrator was the responsibility of the Office of the Attorney General and therefore the federal government.

In 2023, the woman applied to the Federal Department of Finance for compensation of CHF 25,000. The authority rejected the application on the grounds that the woman was not a "relative" within the meaning of the Liability Act relevant here.

The Federal Administrative Court supports this view. The woman had moved in with her boyfriend around one and a half months before the crime and, according to the court, was unable to provide any evidence that would prove a stable partnership.
