Following his re-election, Donald Trump's lawyers are also calling for the proceedings against the US President-elect in the US state of Georgia to be dropped. Presidents in office should not be prosecuted, the lawyers argued in their application to the competent court. Trump moves back into the White House on January 20. As the election fraud proceedings are state-level charges, Trump cannot have the proceedings dropped himself via the Department of Justice - unlike in federal proceedings.

In Georgia, Trump is on trial for his attempts to influence the 2020 election - with several co-defendants. Trump's lawyers have largely blocked the investigation - the prosecutor in charge, Fani Willis, has recently suffered numerous setbacks. The Supreme Court in Georgia is currently dealing with the question of whether Willis should be removed from the case. Should this happen, the entire proceedings could collapse. However, even if Willis were to remain in charge, it is considered unlikely that the trial would be allowed to begin before the end of Trump's second term - i.e. in 2029.
Trump had previously requested that the conviction against him for concealing hush money in New York be overturned. At the end of May, a jury in the US metropolis found Trump guilty on 34 charges. The proceedings in the affair surrounding secret service documents and attempted election fraud at federal level have already been dropped by the public prosecutor's office. They argued with the Justice Department's practice of not investigating sitting presidents.
