US tech billionaire Elon Musk has failed with his lawsuit against the management of ChatGPT developer OpenAI. A jury in California came to the conclusion that Musk had only gone to court after the statute of limitations had expired. The judge ruled accordingly.

Among other things, Musk wanted OpenAI CEO Sam Altman and top manager Greg Brockman to lose their posts and the structure of the AI developer to be changed.

The tech billionaire, an early backer of OpenAI, accused Altman and Brockman of "stealing from a charitable organization". This accusation was central to the trial in Oakland, California, which lasted several weeks.

In the end, however, the timing of Musk's lawsuit in 2024 was decisive. He had already completely stopped supporting OpenAI in 2020 - and was unable to convince the jury that he had only later become suspicious of the behavior of his former comrades-in-arms. In California, the statute of limitations for such allegations is three years.
