The Competition Commission has not yet had to deal with a flood of complaints about relative market power, Competition Commission President Laura Melusine Baudenbacher told the media in Bern on Tuesday.

The regulations on relative market power, which have been in force since 2022, have not led to a large influx of complaints. The Competition Commission, which is responsible for this, completed its first two investigations last year.

In one case, the Competition Commission (ComCo) reprimanded the French publisher Madrigall. The latter was said to be abusing its market power vis-à-vis the Swiss bookseller Payot. The Commission obliged Madrigall to allow Payot to import books directly at more favorable prices.
In contrast, the ComCo launched a second investigation into the medical technology manufacturer Fresenius Kabi. It found that the group had not abused its relative market power vis-à-vis Galexis in the purchase of liquid and tube feeds abroad.
According to the Competition Commission's annual report published on Tuesday, the number of further complaints regarding the provisions on relative market power remained low. Of the eight reports received in 2024, no investigations or preliminary clarifications were opened.
