Swiss citizens should not be able to claim compensation under civil law through class actions. The National Council has not accepted a proposal for new instruments of collective legal protection drawn up by the Federal Council.
The large chamber thus followed a proposal by its preliminary Legal Affairs Committee (RK-N), which sees the danger of an "Americanization" of the Swiss legal system in the bill. With 112 votes in favor, 74 against and four abstentions, the National Council decided on Monday to reject the bill.
Parliament had instructed the Federal Council to draw up proposals for collective legal protection. The Federal Council presented these at the end of 2021, but the National Council then discussed the proposals in detail.
If the Council of States also decides not to adopt the bill, it will fail. If the lower chamber does, it will return to the National Council.
