A fatal accident occurred in Lütisburg Station SG in May 2023. A 35-year-old man hit a female e-biker with his tractor. The 51-year-old was so seriously injured that she died at the scene of the accident.
The tractor driver has now been convicted of involuntary manslaughter. This is the result of a penalty order reported by "20 Minuten".
According to the verdict, the man disregarded the e-biker's right of way at a junction. The tractor driver was traveling at 30 km/h and turned right without stopping.
Collision despite emergency braking
According to the public prosecutor's office, the 35-year-old noticed the woman coming from the left, but did not have a sufficient overview of the traffic situation.
Despite emergency braking, the e-biker crashed into the side of the rear left wheel of the turning tractor. "Even if the 51-year-old had given the defendant a hand signal that she would give way to him, the defendant could not rely on this," the public prosecutor's office wrote in the penalty order.
Due to the imbalance of forces between a tractor and an e-bike, he should have given way to the 51-year-old. In addition, the driver had also acted carelessly and in breach of duty by turning right without looking left and without stopping.
Sentenced to a conditional prison sentence and a fine
At the end of June, the tractor driver was found guilty of involuntary manslaughter, driving an unsafe vehicle and driving without a vehicle registration card or license plates. The St. Gallen public prosecutor's office sentenced him to a conditional prison sentence of six months.
He must also pay a fine of CHF 800 and fees, expenses and legal costs of around CHF 15,870. The penalty order is not yet legally binding.
