The third defendant, former BVB Director Jürg Baumgartner, withdrew his appeal. The verdict in the first instance thus remains with a conditional fine.
In contrast to the judgment at first instance, the Court of Appeal acquitted the former deputy director free of charge. However, it rejected his claim for compensation.
The court confirmed the acquittal of the former Chairman of the Board of Directors, Martin Gudenrath, against whom the public prosecutor's office had lodged an appeal.
The case, which became known in the media as the "expenses scandal", dates back more than eleven years and caused quite a stir in Basel at the time. A report by the Swiss Federal Audit Office in 2013 set the ball rolling. It recorded breaches of rules and overstepping of authority.
