The company gets off with a fine of CHF 5,000. The public prosecutor's office and the French-speaking Swiss consumer protection organization (FRC) had demanded a fine of 1.5 million francs.
Conforama Switzerland, on the other hand, must pay a compensation claim of 1.5 million francs. The court came to the conclusion that the use of false "crossed-out prices" to show the price of an item before the discount had led to unlawful profits, although this had not been done intentionally.
With this sentence, the Cantonal Court confirmed the first-instance judgment on Monday, which was handed down by the District Court of Lausanne in June 2023.
