In addition to the prison sentence, the court imposed a conditional fine and a fine. The senior judges had no doubt that the German man shook his new girlfriend's 20-month-old son so violently at the beginning of June 2021 that the little boy suffered a fatal traumatic brain injury. The court also found him guilty of simple and attempted grievous bodily harm and drug offenses.

With its verdict, the High Court increased the sentence imposed by the Winterthur District Court of First Instance in September 2023. The court had sentenced the man to 12 years and three months' imprisonment, a conditional fine and a fine and ordered him to be deported for eleven years.

The public prosecutor had demanded a prison sentence of 14 years and a 13-year deportation order.
