The fees charged by the canton of Schwyz and its districts and municipalities should have an adequate legal basis. The cantonal government therefore wants to include a corresponding regulation in the Financial Budget Act. The draft law will be submitted for consultation by mid-October.

As announced by the State Chancellery on Monday, the Government Council is reacting to a Federal Supreme Court ruling. This determined that the municipality of Reichenburg SZ did not have a sufficient legal basis to charge fees for long-term parking. In contrast, a decision by the municipal council is sufficient to levy a charge for short-term parking.
The reason for the different legal requirements is that short-term parking is considered "simple public use" and long-term parking is considered "increased public use". The municipalities have reacted to the ruling. However, it is not always clear where the boundary between short-term and long-term parking lies, explained the government council in its consultation message.
This legal uncertainty is to be eliminated with a catch-all regulation. This is not just about parking fees, but also about improving legal certainty with regard to other fees.
Administrative, usage and concession fees as well as the criteria that apply when setting fees are to be regulated in the Financial Budget Act. The Government Council and the district and municipal councils are to be authorized to regulate fees in fee tariffs. The bill would not introduce any new fees or adjust fee tariffs, the State Chancellery announced.
